The Fifth and Fourteenth Amendments establish one of the great principles of American constitutional law: the government must follow the law when it deprives a person of life, liberty, or property.

It sounds straightforward. But entire careers have been devoted to figuring out what those words mean in practice.

Lawyers argue about it. Judges write hundreds of pages about it. Law students discover that the answer to a seemingly simple question is almost always considerably more complicated than the question itself.

DUE PROCESS celebrates the extraordinary idea that fairness isn't simply a matter of good intentions. It requires rules, procedures, and the opportunity to be heard.

Not just when it's convenient. Not just when the person involved is particularly popular. And certainly not just when everyone already agrees on the outcome.

Because the real test of a constitutional principle isn't how well it protects the people we like.

It's how well it protects the people we don't.

Of course, none of this guarantees that everyone will be happy with the decision.

That's what appeals are for.
